TAKE NOTICE: That on January 7, 2019, the Council of the Municipality of Oliver Paipoonge adopted the “Zoning By-law of the Corporation of the Municipality of Oliver Paipoonge” under Section 34 of the Planning Act, as amended.

Purpose: The purpose of the “Zoning By-law of the Corporation of the Municipality of Oliver Paipoonge” is to create a comprehensive consolidated Zoning By-law for the entire Municipality of Oliver Paipoonge. The new By-law is to implement the policies of the Official Plan for the Corporation of the Municipality of Oliver Paipoonge. As per Part 3, Section 26(9) of the Planning Act, R.S.O. 1990, c. P.13, no later than three years after a revision of the Official Plan comes into effect, the council of the municipality shall amend all zoning by-laws to ensure they conform with the official plan. The Municipality of Oliver Paipoonge Official Plan received Ministry of Municipal Affairs approval on April 4, 2018.

Effect:  The Zoning By-law of the Corporation of the Municipality of Oliver Paipoonge is to regulate the use of land; the erection, location and use of buildings and structures; lot size and dimensions; parking requirements; and, building heights within the Municipality of Oliver Paipoonge.

Location:  A key map has not been provided because the Zoning By-law applies to all lands located within the Municipality of Oliver Paipoonge. 

Approval Authority: The Council of the Corporation of the Municipality of Oliver Paipoonge is the approval authority for the Zoning By-law. The last date for filing a notice of appeal is January 30, 2019. Notice must be filed with the Municipal Clerk, must set out the reasons for the Appeal, and must be accompanied by a certified cheque or money order in the amount of $300.00 made payable to the ‘Minister of Finance’.

LEGAL NOTICE: Only individuals, Corporations and public bodies may appeal a By-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a Public Meeting or written submissions to the Council or, in the opinion of the Local Planning Appeal Tribunal (LPAT), there are reasonable grounds to add the person or public body as a party.

A copy of the complete By-law is available for inspection in the Planning Office, Municipality of Oliver Paipoonge 3250 Highway 130, Rosslyn, Ontario during regular office hours. It is also available on the Municipality’s website. A copy of the By-law to adopt the new Zoning By-law is available at the Clerk’s Department at the Municipal Office.  Questions concerning the By-law should be directed to the Municipal Planning Department at (807) 935-2613, Extension 224.
